Now that several states have legalized marijuana, in most places for medical use only, a patchwork of different state laws clash with federal drug laws and raise questions about how to comply with these statutes. One issue concerning employers is how to maintain a drug-free workplace in a state where marijuana is legalized for medical purposes.

Some common questions that we will review include:

  • Is the employer required to accommodate an employee’s use, possession, or distribution of medical marijuana?
  • Is an employer prohibited from refusing to hire, discharge or discipline because of that person’s use, possession or distribution of medical marijuana?
  • Can an employer discharge an employee who tests positive?
